The US Citizenship and Immigration Services (USCIS) is concerned about an upsurge in fraud related with the H-1B visa lottery system.
They saw an increase in fraud in the H-1B registration system when the lottery mechanism was established.
According to the USCIS, the computerized drawing of lots used to select H-1B applicants has resulted in system abuse.
The US government agency also stated that the increase in fraud has caused them to conduct fraud investigations, refuse and revoke petitions, and, in certain cases, submit law enforcement for criminal prosecution.
“We are working on an upcoming H-1B visa modernization rule that will propose, among other improvements, bolstering the H-1B visa registration process to reduce the possibility of misuse and fraud in the H-1B registration system,” the USCIS stated.
A group of US IT workers protesting the H-1B visa said they had been concerned about fraud for numerous years. “The Trump administration had proposed a fix to the H-1B lottery by prioritizing selection based on highest wages,” they stated in a statement. “
“You sued the administration, so now you must deal with the fraud that you are complaining about,” they stated in a statement.”
Individuals who file multiple H1-B visa lottery submissions are examples of these frauds. In 2024, 7,80,884 applications were filed, compared to 483,927 in 2023, 301,447 in 2022, and 274,237 in 2021.
Meanwhile, Donald Lu, the US Assistant Secretary of State for South and Central Asia, announced last week that the US is on track to issue over a million visas to Indians this year.
Lu promised that the USCIS is prioritising work visas, such as H-1B and L visas, and that wait periods for consular sections in India have been reduced to less than 60 days.
“We’ve also prioritised work visas: H-1B and L visas,” Lu remarked. Wait periods for these visas are currently less than 60 days at certain of our consular sections in India. We will continue to emphasise worker visas since they are critical to both the American and Indian economies.”

The H-1B visa is a nonimmigrant work visa that permits firms in the United States to recruit foreign employees with specialised skills to work in the United States for a limited time.
A bachelor’s degree or equivalent is often required for the positions. H-1B visa holders often work in sectors such as technology, finance, engineering, architecture, and others.
