How To Obtain An EAD or Employment Authorization Document?

[google-translator]

Foreign nationals must get an employment authorization document to work in the United States (EAD Card). Here is how to obtain an EAD, which is a perfect approach to demonstrate to employers that you have the right to work in the country.

Employers must confirm that all job applicants in the US, regardless of where they are from, can legally work there before hiring them. Most frequently, immigrants who want to work in the country need to obtain an EAD Card, also known as an Employment Authorization Document.

Having an EAD card is a great method to demonstrate that you have the authorization to work in the US so that you will never have to deal with questions or a lack of paperwork.

How to Apply for an EAD card?

You must submit Form I-765, Application for Employment Authorization, and obtain an EAD. Once you have an EAD, you must:

  • Have employment authorization in the United States due to your immigrant status, and you must provide proof of this authority.
  • Obtain employment authorization; in other words, apply for work permits. For instance:
  1. A Form I-485, Petition to Obtain Permanent Residence or Adjust Status, is still pending.
  2. Your Form I-589, Application for Asylum and Withholding of Removal, is still pending.
  3. You are a non-immigrant with a status that enables you to enter the country but forbids you from working there without obtaining USCIS approval (such as an F-1 or M-1 student).

If you are a legal permanent resident, your Green Card proves that you are authorized to work. Thus you do not need to file for an EAD.

If you hold a non-immigrant visa that enables you to work for a specified employer, you do not additionally need to apply for an EAD. These visas consist of the following:

  • H-1B Visa | Skilled Workers
  • L-1B Visa | Business Expansion
  • O Visa | Extraordinary Ability
  • P Visa | Team Athletes and Performers
  • TN Visa | Canadians and Mexicans Under the NAFTA

Duration of Stay

The combined travel and working permission card are good for a year if the applicant has an open immigrant visa. The combination card will be valid for two years if an immigrant visa is unavailable.

Authorization for Dependents to Work

Family members who meet the requirements and want to travel with an H-1B visa holder but are not allowed to work are granted the H-4 visa. However, having a spouse or dependent with work authorization may be essential in other situations. Thus you may need to file for an H-4 EAD.

Your EAD Card Renewal Procedure

Suppose your EAD is about to expire or has already expired, although you are still qualified for employment authorization. You should apply for an EAD renewal by completing a new Form I-765 and paying the related filing fee unless a fee exemption is requested and approved.

How to Replace an EAD Card?

If your EAD is misplaced, stolen, or destroyed, you can apply for a new one by submitting a new Form I-765 and paying the relevant filing fee unless a fee exemption is requested and granted. You could file a request for information on the non-delivery of a card if you did not obtain an EAD that USCIS mailed.
